A Mexican teen’s effort to remain in Canada failed Friday when a Federal Court judge rejected his effort to stay a deportation order, meaning Daniel Garcia will likely be deported to Mexico on Saturday.

 

Garcia’s lawyers tried to argue the teenager would suffer if he were pulled out of Toronto’s Parkdale Collegiate midway through the school year, because he won’t be able to start school in Mexico until September.

“We’re talking about a kid who’s halfway through school,” said Daniel Kingwell, Garcia’s lawyer.

The Canada Border Services Agency had already rejected that notion, however, and the judge agreed.

Kingwell was disappointed and later Friday afternoon was trying to reach Garcia at the Toronto Detention Centre to give him the news.

Protesters rallied outside the Federal Court of Appeal in Toronto in the morning.

“At this holy time of year, deporting one of Parkdale’s students is counter to everything we tell the world of Canada’s humanitarianism,” Cheri DiNovo, NDP MPP for Parkdale-High Park, said in a statement.

Kenney says teen got fair treatment

Garcia’s supporters have also asked Immigration Minister Jason Kenney to issue him a temporary resident’s permit, but the minister said in a statement Friday morning that he couldn’t discuss the specifics of the case.

“Like all failed asylum seekers facing deportation, he has benefited from all of the rights and privileges available to asylum seekers, including access to our courts and our generous refugee determination system,” Kenney said.

“Nobody is deported until after they have exhausted their appeals. However, once that has happened, we expect them to leave our country and respect Canadian law.”

Garcia, 18, and his sister Brenda, 30, who arrived in Toronto three years ago, said they feared for their lives in Mexico. Brenda said that she was threatened in Mexico for being a lesbian and that her partner was shot to death for being gay.

The judge did not believe Brenda’s claims of persecution, and she was deported to Mexico City on Monday. Daniel was arrested last Thursday, according to friends.
